Bird's Party reserves the right, at its sole discretion, to change, modify, add or
remove portions of these Terms and Conditions at any time. It is your responsibility
to check these periodically for changes.
Bird's Party may make changes to any products or services offered on the Site, or
to the applicable prices for any such products or services, at any time, without
notice. The materials on the Site with respect to products and services may be out
of date, and Bird's Party makes no commitment to update the materials on the Site
with respect to such products and services.
You may not use the Site or any Content for any purpose that is unlawful or prohibited
by these Terms and Conditions, or to solicit the performance of any illegal activity
or other activity which infringes the rights of Bird's Party or others. Privacy Policies:

1) PRINTABLE PRODUCTS
You may use our printable products for PERSONAL USE ONLY. File sharing and commercial
use of these files and derivatives are not allowed. You cannot resell the files,
the designs nor the finished printed product(s) or derivatives arising from parts
thereof. All rights reserved by Bird’s Party. You cannot alter, remove, nor change
the graphics and designs in any way. All misuse is a criminal offence.
* Printable File Format and Download - All printables are emailed to you as PDF files.
We do NOT work with any other file format.
Our PDF files are password protected and you will not be able to edit them after
purchase, unless it is an editable file with specified fields for editing. All our
printables are designed for home printing mainly, or you may also drag and drop the
PDFs onto a USB key or similar device for printing at a professional printers. Since
files are password protected, you will not be able to email them to the printers
nor upload them online.
A list of materials needed and printable instructions are given with each PDF file
you purchase. Files can ONLY be opened in Adobe Reader. Printable files are password
protected and will NOT open in any other programs. MAC COMPUTER USERS: The default
PDF reader program that came with your computer called “Preview” will not work properly.
Please ensure you only use Adobe Reader to opening all PDF files. Bird's Party cannot
be held responsible if you do have the correct piece of software of printing equipment
at your disposal, or try to manipulate or work with the printable files in another
way, other than stipulated by us. Full download and usage instructions are given
with each file, and we cannot be held responsible if you do not follow those.
Please note that there may be variations in colour between on-screen product images
and actual printed files, due to different PC monitors and your printer’s color saturation
settings. Bird’s Party is not responsible for such variations that result.
You will NOT be able to modify any of the printable templates (designs nor text)
after purchase. In some cases, where editable fields are provided, you’ll only be
able to add text in Adobe Reader. For customization beyond that, please email us
for a quote.
* Printable Proof - We offer 1 extra proof for every printable invitation. Please
ensure you type the details of your invites exactly as you want it to appear. If
we make a mistakes with your printable order or text, please email us as soon as
possible to avoid delays to your party. We'll do our best to rectify any problems
as quickly as possible.
* 'Instant Download' Printables - Any printables listed as “Instant Download” means
that you receive a download link immediately after payment is approved. These download
links are also emailed to you, and they expire within 48hrs. Once the files are
downloaded on your computer, you do not need to keep downloading them. You simply
access the PDFs in the folder where the download took place, and proceed as normal
to open and print your printables.
* Personalized Printables - Some printable in-store include personalization by us,
for you. This means that in we can add a first name, age or photo to some of the
templates in that particular printable kit or printable invitation, before the pintables
are emailed to you. This personalization service is always listed in the product
page and included in the price of that specific printable product. You simply provide
your personalization text or photo at the check out, or email them to us after purchase
along with your Order ID and details. Text will be added EXACTLY how you provide.
If you do not provide your personalization text, it can cause delays to your order.
Bird's Party is not responsible for such delays or mistakes. If you do NOT require
personalization, please indicate "no personalization required". In which case, a
generic printable will be emailed instead.
Other printables we carry, do NOT include personalization. Any personalization to
our printable designs which is NOT mentioned in the product listing page (including
colour changes or text - however small it may seem to you) incurs an additional
fee. Please ask for a custom quote in advance. Subject to design time availability.
* Custom-Made Printables - You may also want to place an order for a complete new
printable theme not yet in-store, or require a custom color scheme or modification
to an existing printable design that we carry. The time it takes to complete and
dispatch any custom-made printables may vary depending on the items and the party
themes required, so please ask at the time of ordering for more information. Proof
will be provided where appropriate for custom-made orders. It is the customer's responsibility
to ensure accuracy. Your custom-made order will only be placed and guaranteed for
the required date, once full payment is received in full and in advance. When a custom-made
listing is set up for you, a URL link will be emailed to you for the payment, or
payment may be carried out directly via PayPal.
* Printables in Another Language - You can buy translation service for your each
printable kit you buy, directly at the check out. We currently offer French, Portuguese
and Spanish translations for any of our printable kits. Please allow minimum 7 business
days for processing. For other languages, we require your custom text. Please please
email us for more details and a quote. Subject to design time availability.
2) PAYMENT & PRODUCT DISPATCHING
All product prices for our current site are in US Dollars and we accept payment via
our online payment gateway at Paypal ®. If you do not have a Paypal account you can
still use your credit/debit card through the cart. If you need help, please don't
hesitate to get in touch. Orders can only be processed upon receipt of payment in
full and in advance. Your payment is completely secure on our site. Our online payment
gateway, Paypal ® is kept completely secure and encrypted. To find out more information

If you require a payment in another currency or language, please email us so we can
arrange and set up a custom payment page just for you!
* Party Supplies - Our party supplies are shipped by UPS to US addresses only. For
international orders please inquire by email, or use our EU shop here. More info
on our Shipping page.
We do NOT ship to PO BOXES.
Party supply products can only be dispatched if the correct shipping rates have been
applied for the country/destination you selected at the check out. If the correct
shipping charges have not been selected, it may cause extra delays to your order.
Bird's Party is not responsible for such delays. If you make a mistake, you may contact
us email to rectify the order shipping rates, providing your Order ID Number and
details. An invoice for the extra shipping charges will then be issued.
Shipping times will vary according to the shipping method you selected at the check
out. For more shipping information of our party supply products, please see our Shipping
page. Bird's Party is not responsible for lost, damaged or stolen items, nor delays
incurred during transit.
* Printable Products - Printable products are emailed WORLDWIDE.
We do NOT print or ship any printable products. ALL printable products are emailed
to you in a PDF format to the email your provided at the check out. To avoid these
emails going to spam, it is best to provide a Internet Service Provider email, and
also add us to your address book. Bird's Party cannot be held responsible if your
printables got to spam or are lost or irretrievable by your email server. But should
you have any problems finding them or accessing these emails, then we will do our
best to re-send the files upon receipt and verification of your order ID number.
Because printables are sent to you by email, the purchase of printable products does
NOT incur a shipping charge. Please ensure you follow the instructions on the shopping
cart to select the correct shipping method for your purchase of printables.
Printables that are already listed in the shop are emailed to you in PDF format within
72 business working hours (Mon-Friday). You will receive email confirmation when
your order has been emailed. A rush order service can be provided upon request and
for an additional fee. This is subject to design time availability.
Any printables listed as “Instant Download” means that you receive a download link
immediately after payment is approved. These download links are also emailed to you
and theyexpire within 48hrs.Please also check your SPAM BIN to ensure files have
not been automatically sent there by your email server! If in doubt, always provide
an internet service provider (ISP) email.
Bird’s Party is NOT responsible for accessibility issues of printable files after
purchase - It is the customer’s duty to ensure they have all the functional equipment
and software needed for viewing, printing and cutting all the printables and PDF
documents prior to purchase.
3) REFUNDS & EXCHANGES
* Party Supplies:
We do NOT offer refunds/replacement on already used or opened party supplies. All
items are returnable within 7 days of receipt, minus shipping costs. The customer
is responsible for shipping both ways. Shipping charges will not be refunded. Please
use a carrier with a tracking number and signature confirmation for any returned
items to prevent any lost goods. Lost goods are the responsibility of the buyer,
and refunds will only be issued for goods which reach our warehouse.
Any signs of used products, and unauthorized returns, will not be approved for return,
and reshipment of products will be the responsibility of the buyer.
Damaged Items: If there are any items that arrive damaged, defective or incorrect,
these items could be replaced or refunded. Please contact us within 48 hours of receipt.
and provide digital photos of the damage along with your Order ID and details. All
returns must be authorized first, and you'll be contacted by email with instructions.
Cupcake Stands: Cupcake stands are not eligible for refunds or exchanges.
Outside USA Orders: No returns or exchanges on international orders. You'll be given
a shop credit for damaged items if eligible (see above).
Unauthorized returns, and returns of used items will be not be honored, and will
be subject to a return shipping fee. We regret that we are not able to provide refunds
or honor exchanges for items outside of the 7-day window.
You may email us at shop(at)birdsparty(dot)com for authorization on a return. If
your item is eligible for a return, you will be notified by email with instructions.
Please ensure that any authorized returns are shipped insured with a tracking number
and proof of postage. Bird's Party is NOT responsible for shipping costs on return
items. Bird's Party is NOT responsible for lost, damaged nor stolen packages in transit.
* Printable Products:
Each printable we sell is a unique design and as such, we do NOT give refunds nor
exchanges, under any circumstances for printable. All sales are final, and Bird’s
Party is NOT responsible for accessibility issues of files after purchase - It is
the customer’s duty to ensure they have all the functional equipment and software
needed for viewing, printing and cutting all the printables and PDF documents prior
to purchase. If we make a mistake in your order, we'll do our best to rectify it
as soon as possible. Please email us with your Order ID number and details.
We will do our best to make your buying experience satisfactory in every way. Please
contact us if you are not entirely satisfied.
Void where prohibited by law
Bird's Party is registered and operated in France. Any offer for any feature, product
or service made on the Site is void where prohibited. If you choose to access the
Site from outside of France, you do so on your own initiative and you are solely
responsible for complying with applicable local laws.
